Please read these terms carefully before using the Student Tenants Association platform. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
Welcome to Student Tenant Association ("STA," "we," "us," or "our"), operated by Student Tenants Association LLC. By accessing or using our website at studenttenantassociation.com and any associated mobile applications (collectively, the "Platform"), you ("you" or "User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and Student Tenants Association LLC. Your continued use of the Platform after any modifications to these Terms constitutes acceptance of the modified Terms.
2. Eligibility
You must be at least eighteen (18) years of age to create an account or submit content on the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Users under the age of 18 may browse publicly available content but may not create accounts, submit reviews, file reports, or upload any content.
If you are creating an account on behalf of a business entity (such as a property management company), you represent and warrant that you have the authority to bind that entity to these Terms.
3. User-Generated Content
The Platform enables Users to submit reviews, reports, appeals, responses, and other content ("User Content"). You understand and agree to the following:
3.1 Responsibility for Content
You are solely responsible for all User Content you submit, post, or transmit through the Platform. You represent and warrant that all User Content you submit is truthful, accurate, based on your genuine personal experience, and does not violate any applicable law or the rights of any third party.
3.2 Prohibited Content
You agree not to submit User Content that: (a) is false, misleading, fraudulent, or deceptive; (b) is defamatory, libelous, threatening, harassing, or constitutes hate speech; (c) infringes upon any intellectual property rights, privacy rights, or other rights of any third party; (d) contains personal information of third parties without their consent; (e) is submitted for the purpose of extortion, coercion, or retaliation; (f) impersonates another person or misrepresents your affiliation with any person or entity; (g) contains viruses, malware, or other harmful computer code; or (h) violates any applicable federal, state, or local law or regulation.
3.3 Subjective Opinion; No Guarantee of Accuracy
STA does not guarantee the accuracy, completeness, or reliability of any User Content. Reviews, reports, ratings, and other submissions on the Platform represent the subjective opinions, perceptions, and personal experiences of the individual Users who submitted them — they are not objective statements of fact and do not reflect the views, opinions, or endorsement of Student Tenants Association LLC. Users are encouraged to share their honest impressions, including subjective evaluations of property condition, management responsiveness, communication, value, and other aspects of their tenancy. All reviews and reports are subject to our moderation process as described in Section 4, but moderation does not constitute verification of any factual claim made in User Content, and the publication of a User submission does not transform a User’s subjective experience into a factual statement by STA.
3.4 License Grant
By submitting User Content, you grant Student Tenants Association LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and distribute your User Content in connection with the operation of the Platform. This license is consistent with the Consumer Review Fairness Act (15 U.S.C. § 45b), which protects the right of consumers to share honest reviews.
3.5 Consumer Review Fairness Act Compliance
Nothing in these Terms shall be construed to prohibit, restrict, or penalize any User from posting honest reviews, assessments, or evaluations of any property, landlord, or property management company, in compliance with the Consumer Review Fairness Act of 2016 (15 U.S.C. § 45b). STA reserves the right to remove User Content that is clearly false, misleading, defamatory, unrelated to housing, or otherwise in violation of these Terms, consistent with the exceptions set forth in the Act.
4. Content Moderation & Review Process
4.1 Moderation Process
All reports and reviews submitted by Users are subject to review and moderation by STA administrators before being published on the Platform. This moderation process is designed to filter content that violates these Terms but does not constitute endorsement, verification, or adoption of any User Content by STA. Pursuant to 47 U.S.C. § 230(c)(2), STA undertakes content moderation in good faith to restrict access to material that it considers to be objectionable, and such good-faith moderation efforts shall not be construed as making STA the publisher or speaker of any User Content.
4.2 Dispute & Appeal Process
Property owners and management companies ("Owners") may dispute or appeal reports and reviews through the Platform's designated dispute resolution process. Owners may submit responses, evidence, and appeals that will be reviewed by STA administrators. STA administrators will review disputes in a fair and reasonable manner but are not obligated to resolve disputes in favor of either party.
4.3 Removal Rights
STA reserves the right, but not the obligation, to remove, edit, or disable access to any User Content at any time and for any reason, including but not limited to: (a) content that violates these Terms; (b) content that is subject to a valid legal order; (c) content that STA determines in good faith to be defamatory, misleading, or fraudulent; or (d) content that poses a risk of legal liability to STA or its Users.
4.4 No Obligation to Monitor
While STA moderates User Content prior to publication, STA is under no obligation to monitor, screen, or review all User Content, nor does STA assume any duty to remove content once published unless required by applicable law.
5. Terms for Student Tenants
5.1 Truthful Reporting
As a tenant User, you agree that all reviews, reports, and other submissions are based on your genuine, personal experience as a current or former tenant. You agree not to submit reviews or reports for properties where you have never resided, visited, or had a legitimate tenancy relationship.
5.2 Evidence Requirements
Reports require the submission of supporting evidence, including but not limited to photographs, videos, documents, and a copy of your lease agreement. You represent and warrant that all evidence you submit is authentic, unaltered, and accurately reflects the conditions described in your report.
5.3 Consequences of False Submissions
Submitting false, fabricated, or materially misleading information may result in: (a) removal of the offending content; (b) suspension or permanent termination of your account; (c) referral to appropriate legal authorities if the submission constitutes fraud or defamation; and (d) personal liability for any damages arising from your false submission, including but not limited to legal fees and costs incurred by STA or any third party.
5.4 Not Legal Advice
Information provided on the Platform, including tenant rights information, is for general informational purposes only and does not constitute legal advice. You should consult a qualified attorney for legal advice specific to your situation.
6. Terms for Property Owners & Management Companies
6.1 Account Verification
Property Owners who create accounts on the Platform must provide accurate business information and may be required to verify their identity and ownership or management of claimed properties through STA's property claim process.
6.2 Response Rights
Owners may respond to reviews and reports submitted about their properties through the Platform's designated response mechanisms. Responses must be professional, factual, and must not contain personal attacks, threats, or intimidation directed at any User.
6.3 Dispute & Appeal Rights
Owners have the right to dispute reports and appeal moderation decisions through the Platform. Disputes and appeals must be supported by evidence and submitted through the designated channels. STA will review all disputes and appeals in a timely manner.
6.4 Prohibited Conduct
Owners agree not to: (a) use the Platform to intimidate, threaten, or retaliate against tenants who leave reviews or file reports; (b) create fake accounts to submit positive reviews of their own properties or negative reviews of competitors, in violation of the FTC's Trade Regulation Rule on the Use of Consumer Reviews and Testimonials (16 CFR Part 465); (c) attempt to identify anonymous reviewers for the purpose of harassment or retaliation; or (d) use information obtained through the Platform for any unlawful purpose.
6.5 Subscription Services
Certain features of the Platform are available to Owners through paid subscription plans. Subscription terms, fees, and billing details are as presented at the time of purchase. STA reserves the right to modify subscription pricing with reasonable advance notice.
7. Disclaimers & Limitation of Warranties
7.1 Platform "As Is"
THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STUDENT TENANTS ASSOCIATION LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.2 No Endorsement of User Content
STA does not endorse, verify, adopt, or guarantee the accuracy of any User Content, including but not limited to reviews, reports, responses, or appeals. User Content reflects only the views and experiences of the individual submitting User. STA acts solely as a neutral platform facilitating the exchange of information between Users, consistent with its role as a provider of an interactive computer service under 47 U.S.C. § 230.
7.3 No Guarantee of Outcomes
STA does not guarantee any particular outcome from the use of the Platform, including but not limited to the resolution of disputes between tenants and landlords, the accuracy of tenant rights information, or the improvement of any housing condition.
7.4 Third-Party Content
The Platform may contain links to third-party websites, resources, or services. STA does not endorse and is not responsible for the content, products, or services provided by third parties.
8. Indemnification
You agree to indemnify, defend, and hold harmless Student Tenants Association LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to: (a) your use of the Platform; (b) any User Content you submit, post, or transmit through the Platform; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; (e) your infringement of any rights of any third party, including but not limited to intellectual property rights, privacy rights, and publicity rights; or (f) any claim that your User Content caused damage to a third party.
This indemnification obligation shall survive the termination of your account and your cessation of use of the Platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STUDENT TENANTS ASSOCIATION LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY USER CONTENT POSTED ON THE PLATFORM, INCLUDING BUT NOT LIMITED TO FALSE, DEFAMATORY, OR MISLEADING CONTENT POSTED BY OTHER USERS; (C) ANY DISPUTES BETWEEN USERS, INCLUDING BETWEEN TENANTS AND PROPERTY OWNERS; (D) ANY ACTION TAKEN OR NOT TAKEN IN RELIANCE ON INFORMATION PROVIDED ON THE PLATFORM; OR (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF STUDENT TENANTS ASSOCIATION LLC FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO STA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
10. Dispute Resolution & Governing Law
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
10.2 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute with STA informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days.
10.3 Jurisdiction
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in the State of Florida. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
10.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
11. Intellectual Property
The Platform, including its design, text, graphics, logos, icons, images, software, and other content not constituting User Content, is the property of Student Tenants Association LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or publicly display any portion of the Platform without the prior written consent of Student Tenants Association LLC.
The name "Student Tenants Association," the STA logo, and all related marks are trademarks of Student Tenants Association LLC. You may not use these marks without our prior written consent.
12. Account Termination
STA reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause and with or without notice, including but not limited to situations where: (a) you violate these Terms; (b) you submit false, fraudulent, or defamatory User Content; (c) your use of the Platform poses a risk to STA, its Users, or any third party; or (d) STA is required to do so by law.
Upon termination, your right to access and use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3.4, 7, 8, 9, 10, and 11.
13. Changes to These Terms
STA reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
14. Document Analysis & Lease Review Consent
Certain features of the Platform allow you to voluntarily upload documents (such as lease agreements) and use automated text-consistency checks on your reviews. This Section describes what we do with that content and the consent you provide by using those features.
14.1 Voluntary Nature
Uploading a lease agreement, rental contract, or other document is entirely voluntary. You may submit reviews without uploading any documents, and no Platform feature is gated behind document upload. You may also request deletion of any uploaded document at any time by contacting us at [email protected].
14.2 Purpose of Document Collection
Documents you upload are used for: (a) aggregate analytics intended to identify patterns that may disadvantage tenants (such as atypically restrictive deposit-return language or undisclosed fee structures); (b) benchmarking lease terms across properties, markets, and management companies for the benefit of future tenants; and (c) supporting your own reports where the document is material evidence. Documents are not resold, not licensed to third parties, and not redistributed as individual documents to the public.
14.3 Anonymization Before Analytical Use
Before any uploaded document is used for aggregate analysis, we apply automated redaction to remove personally identifiable information including tenant names, signatures, government identification numbers, payment account numbers, and specific unit numbers where not material to the analysis. The original, un-redacted document is retained in your account for your own reference but is not used for aggregate analysis in un-redacted form.
14.4 Storage and Retention
Uploaded documents are stored encrypted at rest in Amazon Web Services (AWS S3) infrastructure operated on STA's behalf. Documents are retained for as long as your account is active or as needed for ongoing moderation, dispute, or legal processes. You may request deletion of specific uploaded documents or all uploaded documents by contacting us. We will complete verified deletion requests within thirty (30) days unless a legal hold requires preservation.
14.5 Text Consistency Check for Reviews
When you submit a review, we may send the written text of your review and its associated numeric ratings to an automated consistency-check service for the limited purpose of flagging possible contradictions between what you wrote and how you rated (for example, praising maintenance in the text while rating it one star). This check is advisory only: you may always submit your review as written, and no review is rejected, censored, or moderated on the basis of this check alone.
14.6 Third-Party Processors
The text consistency check described in Section 14.5 is performed through Amazon Bedrock, an AWS-managed foundation-model service. Only the review text and the ten numeric rating values associated with that review are transmitted to this service; no lease document, uploaded file, account identifier, or other personal information is sent as part of this check. AWS Bedrock is bound by contractual data-processing terms that prohibit the service provider from using customer input to train foundation models. Under this version of the Terms, uploaded lease documents are not transmitted to any foundation-model service; any future change to that practice will be reflected in an updated version of this Section and announced in accordance with Section 13.
14.7 Your Rights Regarding Uploaded Documents
You have the right to: (a) download copies of documents you have uploaded; (b) request deletion of specific documents or all documents you have uploaded; (c) revoke consent for future analytical use of your uploaded documents (prospective only — aggregate analyses that have already been performed cannot be un-done, but your documents will be removed from future analyses); and (d) receive confirmation of deletion.
